Environmental rights are diagonal if they are held by individuals or groups against the governments of states other than their own. The potential importance of such rights is obvious: governments' actions often affect the environment beyond their jurisdiction, and those who live in and rely upon the environment affected would like to be able to exercise rights against the governments causing them harm. Although international law has not adopted a comprehensive, uniform approach to such rights, human rights law and international (...) environmental law have begun to develop some possible bases for diagonal environmental rights. Human rights law operates primarily along a vertical axis, setting out individuals' rights against their governments and the corresponding duties owed by the governments, but it may also be diagonal, giving rise to duties on the part of states that extend beyond their own territory. The scope and extent of diagonal human rights are often controversial, and environmental rights face additional difficulties, because the environmental protection required by human rights is clarifying only gradually, on a case-by-case basis. To the extent that human rights require such protection when aligned vertically, it would be logical to conclude that they require the same degree of protection whenever they may be aligned diagonally. Human rights law provides few precedents to support that conclusion, however. Compared to human rights law, international environmental law (IEL) provides a clearer and more specific set of duties with respect to environmental protection. Moreover, most IEL is extraterritorial, in that it requires states to regulate actions within their control that could harm the environment beyond their territory. The problem with grounding diagonal environmental rights in IEL is that, in contrast to human rights law, most IEL operates along a horizontal axis: its duties are owed by states to other states, not to private actors. If the challenge for human rights law is to extend rights from the vertical axis to the diagonal, the challenge for IEL is to derive diagonal rights from horizontal ones. (shrink)

The two theories that revolutionized physics in the twentieth century, relativity and quantum mechanics, are full of predictions that defy common sense. Recently, we used three such paradoxical ideas to prove “The Free Will Theorem” (strengthened here), which is the culmination of a series of theorems about quantum mechanics that began in the 1960s. It asserts, roughly, that if indeed we humans have free will, then elementary particles already have their own small share of this valuable commodity. More precisely, if (...) the experimenter can freely choose the directions in which to orient his apparatus in a certain measurement, then the particle’s response (to be pedantic—the universe’s response near the particle) is not determined by the entire previous history of the universe. Our argument combines the well-known consequence of relativity theory, that the time order of space-like separated events is not absolute, with the EPR paradox discovered by Einstein, Podolsky, and Rosen in 1935, and the Kochen-Specker Paradox of 1967 (See [2].) We follow Bohm in using a spin version of EPR and Peres in using his set of 33 directions, rather than the original configuration used by Kochen and Specker. More contentiously, the argument also involves the notion of free will, but we postpone further discussion of this to the last section of the article. Originally published in 1931, Muirhead’s study aims to challenge the view that Locke’s empiricism is the main philosophical thought to come out of England, suggesting that the Platonic tradition is much more prominent. These views are explored in detail in this text as well as touching on its development in the nineteenth century from Coleridge to Bradley and discussions on Transcendentalism in the United States. In the last fifty years there has been a surge of immigration to the Western Hemisphere on the part of Middle Eastern and South East Asian Muslim religious leaders who are responding to a call from Muslim communities for religious leadership. In the United States alone, there have been over 1,500 Muslim clergy in the Sunni Tradition immigrate to America within the last twenty years. What is strikingly absent is the training needed to be a clergy person as understood in (...) American society. There is no question that the imams are well trained in the teachings of Islam and the recitation of the Friday prayers. What quite clearly does not exist is an understanding of the concept of professional ministry on the part of these immigrant imams and this has lead to serious problems for the Muslim communities being served and for the imams who serve them. Based on my major data-base study and subsequent book, Muslim Clergy in America: Ministry as Profession in the Islamic Community (2010), I will explore the essential “components” of professional ministry as understood in American society and will illustrate their value and viability within the Islamic communities in America. Paternalism in the medical care of children is appropriate and ethically justifiable. However, dilemmatic disagreement by paternalistic agents as to which clinical choice is in the child's best interest may occur because of the underlying conflict between two rival standards for the moral value of life: longevity versus quality. Neither standard is unreasonable. Either could be the basis for choice of medical care by the parents or by the pediatrician. Having the child choose between options disputed by his parents and (...) the pediatrician is unlikely to resolve their conflict. Exercise of informed consent by the adolescent requires agreement by his parents to relinquish their paternalistic veto. The probable best-interest choice by the child when he has matured could be reasonably made from either standard. Therefore, the longevity/quality of life question ought not ordinarily to be foreclosed by paternalistic authority which opts for one standard to the exclusion of the other. Medical interventions, paternalistically determined, are justified in the face of deteriorating quality, but only as long as the interventions themselves do not cause deterioration. Application of this limitation of paternalism to the zone of agreement between the rival life standards is made to clinical case examples. Multiple extrinsic criteria may measure the quality of life. Three quality factors, sensation of pain, capacity to communicate and physical functioning are considered. The extent of the zone of agreement between the two life standards varies because quality of life is a relative good, contingent both upon which extrinsic criteria are selected to assess it and upon the priorities which are set among these criteria. Few men have had as much cultural and educational influence on their own countries as the philosopher and educator Antonio Caso (1883-1946). He was above all a patriot of his beloved Mexico, and he sought to deliver his humanitarian message to his countrymen. In his youth, after the revolt against Díaz, he was a member of the Ateneo de la Juventud, a group that sought to bring Mexico, spiritually and economically, back to the Mexicans. Caso realized that this effort involved (...) the forming of a national consciousness among his people, whom he saw divided by their private and public interests. As an educator of Mexican youth for more than thirty years, Caso sought to imbue in his students the desire to search and to question. He saw education as a perpetual search for truth, and his own life and philosophy reflect this search. He rejected any system that proposed to describe all of reality, and he despised all dogmas—official or unofficial. He particularly fought against positivism and Marxism, systems current in his youth. The first part of this book is an introduction to the philosophical and educational ideas of Caso, as well as to the intellectual and political ideas in his life. Mr. Haddox skillfully shows the development of Caso's ideas and how they took shape from his own reading as well as from the experiences of his age and of his country. The second part contains Mr. Haddox's translations of selections from Caso's writings. They give a moving picture of Caso's hopes for Mexico and for humanitiy. (shrink)
